Terms of Use
This page presents the original Terms of Use as requested for publication on the site. It is a broadly drafted document, anticipating future commercial and operational scenarios, and is preserved here as requested by the company owner.
1. General
These Terms of Use constitute a binding legal agreement. Their provisions apply to all use of the plan-b.systems and plan-b.co.il websites and to any purchase of services or digital products made through the site, including purchases made via an application or by telephone, and form a binding agreement between you and Plan-B Systems.
Browsing the site and/or purchasing services or digital products offered for sale on it constitutes your agreement to accept and act in accordance with these Terms. If you do not agree to their terms, you are requested not to make use of the site.
Purchasing services from the site is permitted only to persons aged 18 and over who hold a valid payment method, or to corporations and businesses through duly authorised signatories. Orders cannot be placed without providing the required personal or business details.
The site operator enables the purchase of IT services and technical support, software and integration solutions, cloud and hosting services, application and website development, technology consulting, SaaS services, and additional digital solutions — conveniently, quickly, and easily, at prices that are updated from time to time.
These Terms may be amended at any time by the site operator, at its sole discretion. Use of the site is also subject to the Privacy Policy, which forms an integral part of these Terms.
2. Provision of services
Plan-B Systems will ensure delivery of services purchased on the site in accordance with the delivery terms set out on the service page of each service or digital product.
The date of completion of an order will be deemed to be the date on which the order is confirmed by the customer's credit card company and by the site operator, and only a confirmation of order fulfilment received in the customer's email inbox will constitute confirmation of receipt of the order.
Digital services will be provided online in accordance with the timescales specified on the service page, and their activation is conditional on completion of the registration and identity verification process as required. IT, consulting, development, and integration services will be provided in accordance with timelines agreed between the parties.
The site operator may require additional details or supporting documentation regarding the user and/or the holder of the payment method used for the order. The site operator is also not liable to the customer for any delay not exceeding 7 business days from the date on which the customer gave notice of a delay in receiving the service.
3. Breaches and remedies
The site records and systems of the site operator constitute an institutional record as defined in the Evidence Ordinance and shall serve as conclusive evidence of the matters recorded therein. The site operator shall be entitled, but not obligated, to enforce the site's terms of use and to act in any case where there is reasonable suspicion of a breach thereof.
All copyright and intellectual property rights relating to the site and its content — including text, images, source code, design, and logo — are owned by Plan-B Systems and/or its authorised representatives. Copying, reproducing, distributing, publishing, or using site content without prior written consent is prohibited.
The site operator may cancel any order and/or prevent a user from using the site's services, for any reason, including in cases of unlawful conduct, submission of misleading information, harm to the site, or a manifest and obvious typographical error in the description of a service.
4. Consumer protection / cancellation of transaction
A customer may cancel an order in accordance with the provisions of the Consumer Protection Law, 5741-1981. For the purchase of a service, cancellation is possible within 14 days of the date of the transaction or receipt of the disclosure document, provided that the cancellation is made at least two business days before the scheduled commencement of the service.
The site operator may charge a cancellation fee of 5% of the service price or ILS 100, whichever is lower, in cases where the law permits this. In the case of a digital service that has already been activated and used, cancellation will be subject to the provisions of applicable law and the cancellation policy of the relevant service.
Cancellation of a service may be requested by email, and the refund will be credited to the payment method used for the purchase within 14 days of the date of the request.
5. Disclaimer and limitation of liability
The site operator will not be liable for any damage caused in connection with or as a result of the use of the site and/or the services, including for any act or omission of a third-party service provider, except as expressly stated in this agreement and subject to mandatory provisions of applicable law that cannot be excluded by contract.
The service on the site is provided as is (AS IS), without any representation or implied warranty. The site operator does not warrant that the service on the site and/or the digital services will be uninterrupted, delivered on a regular basis, or free from faults.
The site operator and/or its authorised representatives will be liable for direct and tangible damages only, and will not be liable for indirect, consequential, or special damages, including loss of income or loss of profit.
6. Privacy policy, data collection and retention
The site's Privacy Policy forms an integral part of these Terms. The site operator undertakes not to misuse information without the user's consent, unless required by law or in order to prevent misuse and protect its rights.
Information about a user may include all details provided directly or indirectly by the user, as well as details arising from the user's activity on the site. All such information will be stored in the Company's databases and servers for the duration of the customer's active subscription period, and will be deleted following the termination of the engagement in accordance with the deletion policy.
The site operator may send operational notices, feedback surveys, service notifications, system messages, and promotional communications, and may transfer information to affiliated parties and third parties for the purpose of providing services, offering related services, advertising, and statistical analysis.
The user may request removal from a mailing list or deletion from the site operator's database, in accordance with applicable law and by submitting a written request.
7. Use of IT services and digital products — additional terms
Services and digital products are granted to the customer on a use licence basis only, and do not involve a transfer of ownership, unless expressly stated otherwise. Reverse engineering, decompilation, or any attempt to expose the source code is prohibited.
The site operator will endeavour to provide its digital services at a high level of availability, but does not warrant full availability and is not liable for service interruptions arising from maintenance, force majeure, or third-party faults.
Responsibility for data backup rests with the customer, unless otherwise stated on the service page. The site operator applies reasonable and industry-standard security measures, but no security system is entirely impenetrable.
8. General
The interpretation and enforcement of these Terms and any act or dispute arising from them will be governed by the laws of the State of Israel and will be heard by the competent courts in the Tel Aviv or Central District.
Plan-B Systems may offer benefits and promotions at its sole discretion. The sites are made accessible in accordance with all applicable law, and periodic reviews are conducted to ensure that accessibility is maintained and that an optimal user experience is provided.
The site operator will not be liable for any delay or failure in performing its obligations in the event of force majeure, including war, natural disaster, pandemic, strike, widespread power outages, or unforeseen communications failures.
